TERMS AND CONDITIONS OF USE AND CONTRACTING

These General Conditions govern access to and use of the Marhaba Marbella platform (hereinafter, “the Platform”), as well as the commercial relationships between the Owner, Users and external Providers.

1. ACCEPTANCE OF TERMS

By accessing, registering or using any service on the Platform, you (hereinafter, the “User” or “Provider”) fully and unreservedly accept these Terms and Conditions. If you do not agree with any of the clauses, you must refrain from using the Platform.

2. NATURE OF THE PLATFORM (INTERMEDIARY MODEL)

Marhaba Marbella is a technological intermediary and lead-generation tool (Lead-Gen).

Function: To connect individuals interested in luxury services and assets on the Costa del Sol with selected professional providers.

No Service Provision: The Owner of the Platform does not sell, rent, provide security services, practice medicine or operate transport fleets. The final contractual relationship is established exclusively between the User and the external Provider.

3. REGISTRATION AND USER ACCOUNTS

In order to access certain functionalities (requesting quotations, publishing services), it is necessary to create an account.

Accuracy: The User/Provider undertakes to provide real data (name, email, phone number).
Security: Credentials are personal and non-transferable. Any activity carried out under your account will be your responsibility.
Provider Profile: Providers registering in the “Supplier Portal” guarantee that they possess all licenses and insurance required to carry out their activity in Spain.

4. SPECIFIC CONDITIONS BY VERTICALS

4.1. Living and Mobility (Real Estate, Yachts, Jets)

Marhaba Marbella acts as a showcase. Prices, availability and technical characteristics are provided by the Providers. The Platform does not guarantee the accuracy of such data nor is it responsible for hidden defects in the assets.

4.2. Services (Security and Health) - DISCLAIMER CLAUSE

Emergencies: In the event of a life-threatening emergency, the User must contact 112. The Platform does not guarantee medical or security response times.
Responsibility: Operational, clinical or technical responsibility lies exclusively with the Provider (licensed security company or certified healthcare professional). Marhaba Marbella is exempt from any liability arising from the execution of these services.

5. ECONOMIC REGIME AND COMMISSIONS (B2B)

For the User: Access to and use of the platform to request information is free of charge, unless otherwise indicated for personalized consultancy services.
For the Provider (Affiliate Model): The Provider accepts that the relationship is governed by an Affiliate Commission model. The Provider undertakes to pay the fees privately agreed upon for each transaction resulting from a contact (lead) generated by Marhaba Marbella.

6. INTELLECTUAL PROPERTY

All website content (design, code, Luxury Boutique interface, Arabic RTL reading system and logos) is the exclusive property of the Owner. Data extraction (scraping) or reproduction of content without express authorization is prohibited.

7. PRIVACY AND CONFIDENTIALITY

The processing of personal data is detailed in our Privacy Policy. Marhaba Marbella undertakes to maintain a rigorous standard of confidentiality, protecting the identity and consumption habits of its users, especially those with high-profile backgrounds.

8. DISCLAIMER OF LIABILITY

The Owner shall not be responsible for:

Misunderstandings or contractual breaches between User and Provider.
Damages arising from the use of information published by third parties.
Loss of profits or indirect damages arising from the use of the Platform.

9. MODIFICATIONS

The Owner reserves the right to modify these Terms at any time. Continued use of the Platform after a modification implies acceptance of the new terms.

10. DISPUTE RESOLUTION, JURISDICTION AND LANGUAGE

ODR Platform: In compliance with EU regulations, we inform users of access to the online dispute resolution platform: https://ec.europa.eu/consumers/odr/.
Prevailing Language: In the event of discrepancies between translated versions (English, Arabic) of this document, the Spanish version shall be the only legally binding version.
Law and Jurisdiction: These terms are governed by Spanish law. For any dispute, the parties submit to the Courts of Marbella (Spain).
